EMPLOYMENT LAW / ADMINISTRATIVE LAW:
Attorneys associated with Goins, Graham and Associates, LLC offer legal assistance to employees who are subject to mandatory interviews, disciplinary hearings (contested and uncontested cases), have been terminated or subject to discipline. We offer proactive consultation and contact with employees in an effort to avoid discipline and/or termination by developing strategies and educating the employee to protect their interests. We also negotiate and prepare employment contracts.
Employers may not hire, promote, demote, terminate or otherwise discriminate against an employee or applicant for employment because of age, race, sex, or other criteria protected by federal and state law. The Age Discrimination in Employment Act (ADEA) prohibits age discrimination against employees 40 and over. Title VII of the Civil Rights Act of 1964 prohibits discrimination on the basis of race, color, religion, sex, or national origin.
"AT WILL EMPLOYEE" is the legally recognized status under which most workers in the state of Missouri work, perform their duties and occupy their position of employment. What this means is that employers generally can terminate workers (at will employees) AT WILL, so long as the reason does not violate the US Constitution, the Missouri Constitution or any relevant statutes or contract, collective bargaining agreement or legally enforceable promise. Wrongful discharge is a catchall phrase for all the exceptions to this general rule.

Generally, YOU HAVE THE RIGHT, to a hearing or to give your side of the story if you a contract worker, or worker under a collective bargaining agreement (see the contract or the agreement)

NEVER ADMIT FAULT, but tell the truth and generally refuse to answer unfair questions or questions which assume any facts to which you do not agree or acquiesce, you generally have the right to representation in the form of an attorney or a union representative

If you have legitimate property interest then you are probably protected under Chapter 536 of the Revised Statutes of Missouri

If you are an "at will" employee, generally you have no protection and can be terminated for any reason so long as that reason does not violate an applicable statute or the US or Missouri Constitution.

Our firm is available and work pursuant to signed contracts with clients. Each contract is different and is based on the facts and the goals of the client.
