The criminal justice system is blind and has many interests involved, but one thing is a constant:
"you as a person accused of a crime are in a much better position to protect yourself if you have exercised your rights to remain silent until you have had the opportunity to obtain the advice of an experienced attorney."
We are often amazed at the "innocent" person accused of a crime, who confidently states that he or she has nothing to hide therefore they do not need an attorney and will voluntarily make statements or otherwise fail to exercise their rights to remain silent.
Those accused and facing charges or an investigations are advised to do the following:

1. Remain silent. This means that whenever you are asked a question you exercise your right to remain silent and ask for an attorney, UNTIL YOU ARE GIVEN ONE. This also means:

a. If you are in custody do not discuss the matter with guards, or fellow prisoners ever.

b. If you are not in custody do not discuss the matter with anyone.

2. Never agree or say yes, when asked by any law enforcement person if they may search an area, come inside or do anything. Always say or respond, NO!! Never voluntarily "allow" the search.

3. The police are allowed to lie, misinform and otherwise hide the truth. This is exactly what an informant or undercover police officer is or does. Do not engage in this game, simply respond NO and ask for an attorney.

4. The police are generally allowed to stop you and conduct frisks of you and your surrounding area. However, if ever given the choice always respond NO.

5. Always follow the instructions given by the police or any law enforcement officer, but make your "no" clearly understood.

6. Remember that the police are trained to stop, arrest and convict people, they are not generally in the business of protecting the innocent this is your job!!

7. Never admit fault or any fact, this will be used against you in the court proceeding.

8. Never admit that you were speeding, parked illegally or anything.
